Conditions

1. Scope

  • For all orders placed through our online shop, the following terms and conditions (T&Cs) apply. Our online shop is exclusively aimed at consumers.

  • A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legally capable partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

 

2. Contractual Partner, Conclusion of Contract, Correction Options

  • The purchase contract is concluded with SpinWorlds.

  • By placing the products in the online shop, we make a binding offer to conclude a contract for these articles. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

 

3. Contract Language, Storage of Contract Text

  • The language(s) available for the conclusion of the contract: German, English

  • We store the contract text and send you the order data and our T&Cs in text form. You can view the contract text in our customer login area.

4. Delivery Conditions

  • In addition to the stated product prices, shipping costs will be added. You can find more details about the amount of the shipping costs in the offers.

  • We only deliver by post. Unfortunately, a self collection of the product is not possible.

5. Payment

a.) Credit Card

  • When placing the order, you provide your credit card details. After your legitimation as the rightful cardholder, the payment transaction will be carried out automatically, and your card will be charged.

b.) PayPal

  • During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal immediately afterward. Further information is available during the ordering process.

c.) Sofort by Klarna

  • After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To be able to pay the invoice amount via Sofort, you must have an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction to us. Further information is available during the ordering process. The payment transaction will be carried out immediately afterward by Sofort, and your account will be debited.

d.) Giropay

  • After placing the order, you will be redirected to the website of your bank. To be able to pay the invoice amount via Giropay, you must have an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction to us. Further information is available during the ordering process. The payment transaction will be carried out immediately afterward, and your account will be debited.

e.) Invoice

  • You pay the invoice amount by bank transfer after receiving the goods and the invoice. We reserve the right to offer the purchase on account only after a successful credit check.

5.1 Vouchers (Gift Cards)

a.) Validity and Redemption

  • Vouchers purchased on our website are valid for two years from the date of issue. After this period, the vouchers expire and can no longer be redeemed.

b.) Redemption Conditions

  • The voucher can only be redeemed in the online shop "www.spinworlds.de". Only one voucher can be used per order. A cash payout of the voucher value is excluded.

c.) Transferability

  • Vouchers are transferable. The voucher holder is responsible for the proper storage and use of the voucher. We do not accept any liability for the loss, theft, or misuse of the voucher.

d.) Remaining Balance

  • If the value of the voucher is not sufficient for the total purchase price, the difference can be settled with the available payment methods. Any remaining balance will remain on the voucher and can be used for further purchases within the validity period.

e.) Misuse and Blocking

  • In case of suspected misuse, we reserve the right to block the voucher and, if necessary, take further legal action.

5.2 Delivery of Mystery Boxes

a.) Contents of the Mystery Box

  • Our Mystery Boxes contain a selection of randomly chosen items. Please note that no physical box is delivered; instead, you will receive only the contents of the Mystery Box.

b.) Returns and Cancellation Rights

  • The right to cancel applies to the purchased contents of the Mystery Box. Since no physical box is delivered, returns or exchanges are accepted only for received items that are damaged or faulty. There is no right of return if the selection of items does not meet personal preferences.

c.) Price and Shipping Costs

  • Prices for Mystery Boxes and any applicable shipping costs are specified during the ordering process and are shown separately.

d.) Availability and Delivery Time

  • The availability of Mystery Boxes and the estimated delivery time will be communicated to the buyer during the ordering process.

e.) Privacy

  • The processing of personal data is carried out in accordance with our Privacy Policy.

 

6. Retention of Title

  • The goods remain our property until full payment has been made.

7. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies. In the case of used goods, the following applies: if the defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects that occur within one year of the delivery of the goods can be claimed within the statutory limitation period of two years from the delivery of the goods. The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives, or agents

  • in the case of injury to life, body, or health

  • in the case of intentional or grossly negligent breach of duty as well as fraudulent intent

  • in the case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations)

  • as part of a guarantee promise, if agreed, or

  • as far as the scope of the Product Liability Act is opened. Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability

We are always fully liable for claims based on damage caused by us, our legal representatives, or agents

  • in the case of injury to life, body, or health

  • in the case of intentional or grossly negligent breach of duty

  • in the case of guarantee promises, if agreed, or

  • as far as the scope of the Product Liability Act is opened. In the event of a breach of essential contractual obligations, whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives, or agents, the liability is limited in amount to the damage foreseeable at the time of the conclusion of the contract, which must typically be expected. Otherwise, claims for damages are excluded.

9. Dispute Resolution

  • The European Commission provides a platform for online dispute resolution (OS), which you can find here. Consumers have the option to use this platform for resolving their disputes.

  • To resolve disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The responsible body is AVS NRW e.V., c/o Geschäftsstelle Kölner Anwaltverein, Oberlandesgericht Köln, 3. Etage, Zimmer 316, Reichenspergerplatz 1, 50670 Köln, https://www.vergleichung-nrw.de . We will participate in a dispute resolution procedure before this body.
